Welcome to Quell. These Terms and Conditions ("Terms") govern your access to and use of the Quell mobile application ("Application"), developed and operated by Software Flow Yard S.R.L. ("Company", "we", "us", or "our").
By creating an account, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not install, access, or use the Application.
Quell is an anti-hoarding read-later mobile application designed to assist users in managing saved content links through strict queue limitations and intentional consumption tracking. The core mechanic is a hard queue limit that forces intentional saving and honest follow-through tracking. The Application connects to a cloud backend infrastructure to synchronize your data across your authorized devices.
2.1. You must be at least 13 years of age (or the minimum legal age in your country) to create an account and use the Application.
2.2. To use certain features of the Application, you must register for an account by providing a valid email address and creating a secure password. You agree to provide accurate, current, and complete information during registration.
2.3. You are entirely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately of any unauthorized use or suspected security breach of your account.
You agree that you will not use the Application to:
4.1. The Application, including its source code, design systems, layouts, logos, user interface elements, graphics, and original text, is the exclusive property of Software Flow Yard S.R.L. and is protected by intellectual property, trademark, and copyright laws.
4.2. We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application strictly for personal, non-commercial use on mobile devices that you own or control.
The Application allows you to save and access links to third-party websites, articles, videos, and media. We do not own, control, endorse, monitor, or assume any responsibility for the content, privacy policies, practices, availability, or accuracy of any third-party websites. You acknowledge and agree that we are not liable for any damages or losses caused by your interaction with third-party web endpoints.
6.1. The Application is provided to you on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, uptime, or error-free performance.
6.2. To the maximum extent permitted by applicable law, Software Flow Yard S.R.L., its directors, employees, or partners, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, or server downtime resulting from your access to or inability to use the Application.
7.1. User Termination: You have the right to terminate your account and wipe your data at any time. The Application provides an explicit, permanent account deletion mechanism within the interface. Executing this option will instantly initiate an automated, non-reversible wipe of your user record and accumulated application state from our active databases.
7.2. Company Termination: We reserve the right to suspend or terminate your access to the Application at our sole discretion, without prior notice, if we believe you have breached these Terms, engaged in fraudulent behavior, or created security risks for our infrastructure.
These Terms and their interpretation shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles. Any legal disputes, claims, or proceedings arising out of or related to these Terms or the use of the Application shall be subject to the exclusive jurisdiction of the competent courts located in Cluj-Napoca, Romania.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice within the Application or via your registered email address prior to the new terms taking effect. Your continued use of the Application following the publication of any modifications constitutes your formal acceptance of the updated Terms.
